JUDGMENT:

(per Hon'ble The Chief Justice Sri G. Narendar)

Heard the learned counsel for the petitioner.

2. The grievance of the petitioner is that they had filed

an application dated 29.05.2025, seeking leave of the

Court to withdraw the recovery proceedings in view of the

fact that an OTS has been sanctioned by the bank and

that pursuant to the OTS, the debtor had also deposited

all the amounts, despite the settlement of the loan

account, the Tribunal has not allowed the withdrawal

application.

3. In that view, the notices to the respondents are

dispensed with in view of the order to follow.

4. The Debts Recovery Tribunal of Uttarakhand at

Dehradun shall consider and dispose of R.C. No. 347 of

2024 filed in O.A. No. 478 of 2023 on the next date of

hearing.

5. The Writ Petition stands ordered accordingly.

6. Registry to communicate this order to the concerned

DRT by e-mail.
