Mr. Gaurav Singh, Advocate for the appellant.
Mr. Siddharth Bisht, A.G.A. for the State. The appellant has been convicted and sentenced under Section 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ("the Act") and sentenced under Section 20 (b)
(ii) (C) of the Act by the judgment and order dated 08.12.2023, passed in Special Sessions Trial No. 05 of 2017, State of Uttarakhand Vs. Surjeet Singh @ Ladi by the court of 3rd Additional Sessions Judge, Haridwar. He proposes to file an appeal, which is delayed by 67 days.
Objection has also been filed to the delay condonation application.
Learned counsel for the appellant would submit that the appellant is in jail. There is no one to look after and take care of him. Therefore, delay has occurred.
Having considered, this Court is of the view that there are good grounds to condone the delay. Delay Condonation Application No. 1 of 2024 is allowed. Delay in filing the appeal is condoned.
