1. Ms. Neelima Mishra Joshi, learned Legal Aid counsel for the Appellant.
2. Mr. V.S. Pal, learned AGA for the State.
3. It is a Jail Appeal preferred on the letter of the Jail Superintendent dated 17.07.2024.
4. Ms. Neelima Mishra, learned Legal Aid counsel, submits that since the certified copy of the judgment was not enclosed alongwith the letter of Jail Superintend, the appeal could not be filed within time.
5. If the certified copy was not enclosed alongwith the letter, then the appeal should be filed immediately by moving an exemption application, but that has not been done. Apparently, there is a lapse, however, taking into consideration that it is not the fault of the appellant, who is in jail and there is no any purpose for asking the response on such a delay condonation application, therefore, this Court is of the view that delay, in preferring the appeal, deserves to be condoned.
6. The delay is condoned.
7. Admit.
8. Summon the trial Court Record.
9. Let the objection(s) to the bail application (IA/2/2025) be filed within two weeks.
10. List this matter on 10.03.2025.
