1. Mr. Anil Kumar Joshi, learned counsel for the petitioner.

2. Mr. Pradeep Hairiya, learned Standing Counsel and Mr. Tarun Mohan and Mr. Hargovind Pant, learned Brief Holder for State.

3. By the instant petition, petitioner is prayed for following reliefs:

"Issue a writ, order or direction in the nature of Mandamus commanding the respondents to pay the salary to the petitioner from the State Fund and absorb the services of the petitioner on the post of Assistant Teacher from the date the Institute was taken into the grant in aid scheme."

It is contended by the learned counsel for the petitioner that issue raised in the present writ petition is squarely covered by the judgment passed by this Court in WPSS No. 3491 of 2018 (Mamta Sah Vs. State of Uttarakhand and others) decided on 02.03.2022, which was affirmed by the Division Bench of this Court by judgment dated 05.03.2024 passed in Special Appeal No. 385 of 2022 and the same was also affirmed by the Hon'ble Apex Court by order dated 09.05.2025 passed in SLP (Civil) Diary No. 39856 of 2024.

5. Mr. Pradeep Hairiya, learned Standing Counsel for the State has fairly submits that issue raised in the present writ petition is squarely covered by the aforesaid judgment.

6. In view of the submission as above, present writ petition is disposed of in terms of judgment passed by this Court in WPSS No. 3491 of 2018 (Mamta Sah Vs. State of Uttarakhand and others) dated 02.03.2022, which was affirmed by the Division Bench of this Court by judgment dated 05.03.2024 passed in Special Appeal No. 385 of 2022 and further affirmed by the Hon'ble Apex Court by order dated 09.05.2025 passed in SLP (Civil) Diary No. 39856 of 2024.
