Mr. Monika Pant, learned counsel for the appellant/Insurance Company through Video Conferencing.
2. Mr. Rajyavardhan Chaudhary along with Mr. Hardik Sah, learned counsel for respondent nos. 1 & 2.
3. This appeal is directed against the judgment and award dated 12.06.2025 passed by the learned M.A.C.T./District Judge, Pithoragarh in M.A.C.P. No. 23 of 2024, whereby a sum of ₹13,25,640/- has been awarded in favour of the claimants.
4. Learned counsel for the appellant/Insurance Company would submit that the compensation awarded is excessive, as the learned Tribunal, while passing the impugned award, has failed to appreciate the evidence and material available on record.
5. Issue notice to respondent nos.3 to 5.
6. Steps to be taken within two weeks.
7. List this case on 30.10.2025.
8. In the meantime, execution of the judgment and award dated 12.06.2025 passed by the learned M.A.C.T./District Judge, Pithoragarh in M.A.C.P. No. 23 of 2024 shall remain stayed, subject to the condition that the appellant/ Insurance Company deposits the entire awarded amount before the Tribunal concerned within a period of four weeks from today.
