HIGH COURT OF UTTARAKHAND AT NAINITAL
Writ Petition No. 3674 of 2024 (M/S)
Pratap Singh Gusain ..........Petitioner
Vs.
State of Uttarakhand and others ........ Respondents
Present : Ms. Harshi Gupta, Advocate holding brief of Mr. Yogesh Pant,

JUDGMENT
Hon'ble Ravindra Maithani, J. (Oral)
By means of the instant petition, the petitioner
seeks directions to the respondent no.2, the District
Magistrate, Tehri Garhwal, to decide the application
09.09.2016, filed by the petitioner, which is Annexure
No.1 to the petition.
2. Heard learned counsel for the parties and
perused the record.
3. Learned counsel for the petitioner would
submit that the petitioner had filed an application for
allotment of land for mining on 09.09.2016, to the
respondent no.2, The District Magistrate, Tehri Garhwal,
but it has yet not been decided.
4. Learned State Counsel would submit that the
application has already been decided on 11.06.2018. He
would submit that now the mining lease is to be given, as
per e-auction.
5. The Court takes on record the statement given
by learned State Counsel.
6. Since the application dated 09.09.2016 given
by the petitioner has already been decided, and, further, a
statement has been given that process for lease of land for
mining would be carried out by e-auction, nothing
survives in this petition. It stands disposed of at the stage
of admission itself.
