The Court made the following:


JUDGMENT:

Counsel for the State, on instructions, informs

that the department is ready for conducting arbitration

proceedings as per sub-clause (c) of clause 1.3.01 of the

contract agreement executed between the parties,

contained at page 20 (Annexure-3).

2) The amount involved in the present case is

about rupees twenty seven lakhs, and the seat of

arbitration is at Dehradun.

3) Keeping in view this fact, I proceed to appoint

Mrs. Meena Tiwari, Retired District and Sessions Judge,

who is residing in Dehradun, as the sole Arbitrator to

adjudicate the disputes which have arisen between the

parties under the contract agreement in question. The

seat of arbitration will be at Dehradun.

4) The Arbitration application stands disposed of

accordingly. Consent may be sought from the Arbitrator

under Section 11(8) of the Arbitration and Conciliation

Act.
