Hon'ble Rakesh Thapliyal, J.
1. Mr. Sanjay Bhatt, learned counsel for the petitioners submits that in both the petitions, the petitioners are praying for regularization of their services, which, in fact, has not been considered since Regularization Rules of 2013 were kept in abeyance vide order dated 04.12.2018, in WPSB No. 616 of 2018. He submits that the said order, keeping the Regularization Rules in abeyance, was subsequently
2024:UHC:8611 modified on 22.02.2024, the copy of which is enclosed as Annexure -7 to the petition.
2. Learned counsel for the petitioners submits that pursuant to the order passed by the Division Bench whereby earlier order keeping the Regularization Rules in abeyance was modified by order dated 22.02.2024, and the present petitioners are entitled to be considered for regularization as per order dated 22.02.2024 passed in WPSB No. 616 of 2018.
3. Mr. P.S. Bisht, learned Addl. C.S.C. for the State has not disputed this fact that earlier order by which the Regularization Rules were kept in abeyance has been subsequently modified by the Division Bench.
4. Since, the petitioners are claiming regularization, therefore, respondents are directed to consider the candidature of the petitioners for regularization strictly as per Rules prevailing therein as well as in the light of the judgment passed by the Division Bench dated 22.02.2024 in WPSB No. 616 No. 2018 within a period of two months from the date of production of certified copy of this judgment.
5. In view of the observations and directions as above, both the writ petitions stand disposed of.
