JUDGMENT :
(per Ms. Ritu Bahri, C.J.)
Learned counsels for both the parties are not
disputing the fact that the Arbitrator was appointed on
02.12.2019, and he has not proceeded to do anything in
this case after being appointed as an Arbitrator.
2. Learned counsel for the respondent has
further informed that recently again a letter was sent on
06.04.2024 to the Arbitrator Mr. Kamlesh Kumar, but no
response has been received.
3. Keeping in view that the matter is pending
before the Arbitrator since February, 2019, and no steps
have been taken by the Arbitrator, this Court proceeds
to appoint a fresh Arbitrator, the arbitration proceeding is at Dehradun, and the amount involved is Rupees
Thirty Lakh.
4. Let Dr. S.S. Pangti, is appointed as an
Arbitrator, who is presently residing at Dehradun.
5. In view of the above, the application is
disposed of.
