JUDGMENT :
The parties are not in dispute, with respect to
the existence of the arbitration clause in the contract,
i.e. Clause No. 39 at Page No. 13 of the paper-book,
which states that, in the event of any dispute arising out
of this MOU, the same shall be resolved through
arbitration at Dehradun.
2. Counsel for both the parties state that a sole
Arbitrator can be appointed, and the seat of arbitration
will be at Dehradun. The amount involved is Rupees
Twenty Five Lakhs.
3. Accordingly, this Court proceeds to appoint
Ms. Meena Tiwari, Retired District & Sessions Judge, as the sole Arbitrator. Consent be sought from the learned
Arbitrator as per Section 11(8) of the Arbitration and
Conciliation Act, 1996.
4. The Arbitration Application stands disposed
accordingly.
5. Pending application(s), if any, also stand
disposed of accordingly.
