IA No.10601 of 2023 (Delay in Recall Application) has been moved by the respondent no.5 for recalling ex-parte judgment dated 19.01.2022 on the ground that the counsel representing respondent no.5 could not present when the judgment was pronounced, since the counsel for the respondent no.5-The New India Assurance Company Limited, was suffering from Covid-

19. There is delay in moving this recall application, for which Mr. Dharmendra Barthwal seeks two weeks' time to file objection on the delay condonation application filed in support of the aforesaid recall application.

6. In the meantime, counsel for the appellant, Mr. Dharmendra Barthwal, undertakes that the appellant will not proceed further to press the recovery proceedings initiated against The New India Assurance Company Limited-respondent no.5.
