(1) Mr. Tarun Lakhera, learned counsel for the revisionist.

(2) This is tenant's revision under Section 25 of Provincial Small Cause Courts Act, 1887 against the judgment dated 21.06.2023 passed by learned Judge, Small Causes/Additional District Judge, Karanprayag, District Chamoli in SCC Cause Suit No. 01 of 2019. Learned trial court has ordered for eviction of revisionst and revisionist has also been directed to pay arrears of rent within 30 days.

(3) Learned counsel for revisionist submits that revisionist is ready and willing to vacate the shop in question for which he needs nine months time for looking for some alternative accommodation.

(4) In such view of the matter, let notice be issued to respondent returnable within four weeks.

(5) In addition to normal mode of service, revisionist is permitted to serve respondent personally.

(6) Steps to be taken within a week.

(7) List this case on 18.10.2023.

(8) Till next date of listing, revisionist shall not be dispossessed from the shop in question, provided revisionist deposits the entire arrears of rent before the learned trial court within ten days and continue to pay the amount of mesne profits at the rate indicated by learned trial court in the impugned judgment, on or before 7th day of each succeeding month, to the landlord (respondent herein).

(9) Stay application (IA No. 1 of 2023) stands disposed of.
