Mr. Deep Chandra Joshi, learned counsel assisted by Mr. Pankaj, learned counsel for the appellant/applicant.

2. As per office report, there is a delay of 262 days' in filing this appeal, under Section 378(4) of Criminal Procedure Code, against the judgment dated 13.12.2022 rendered by learned Additional Chief Judicial Magistrate/ 2nd Additional Senior Civil Judge, Haridwar, in Complaint No. 384 of 2016, Smt. Brishala Devi Vs. Krishna Kumar Tyagi, whereby respondent/accused has been acquitted of the charge for offences punishable under Section 138 of the Negotiable Instruments Act.

3. Issue notice to the respondent on Delay Condonation Application and also application seeking leave to appeal, returnable within six weeks.

4. Steps be taken within one week from today.

5. Let the Lower Court Record be summoned.

6. List on 15.02.2024.

7. In the meantime, objection(s) to Delay Condonation Application as well as application seeking leave to appeal be filed.
