The petitioners are plaintiffs in an election petition proceedings preferred under Section 131(H)(1)(2)(i) of Uttarakhand Panchayati Raj Act, 2016.
The said proceedings are pending by way of a Case No.2 of 2022-23, "Shayra and Another Vs. Election Officer and Others" before the court of SDM, which is the Election Tribunal under the Act.
Time and again, the Hon'ble Supreme Court has been consistently observing that the Election Proceedings are to be decided expeditiously because the time plays a very pivotal role because with an efflux of time if the controversy pertaining to the election is not decided, the lis will render infructuous.
Owing to the aforesaid wider guidelines laid down by the Hon'ble Apex Court, this writ- petition is being disposed of with a request to the court of respondent no.1 to make all efforts to decide the Election Petition as referred above, as expeditiously as possible, but not later than six months from the date of production of a certified copy of this judgment.
