The petitioners seek de-freezing of their accounts, which were freezed by the Investigating Officer.
Today, when the matter is taken up, learned counsel appearing for the respondent no.3, Mr. Parikshit Saini, would submit that the petition is not maintainable in view of the judgment in the case of Teesta Atul Setalvad Vs. State of Gujarat, (2018) 2 SCC 372.
On 18.04.2023, this Court had required State to file objections, but notices have not been issued to the respondents.
Admit.
Issue notice to the respondent no.4 returnable within four weeks.
Steps to be taken within a week. Respondents to file objections within two weeks.
Two weeks thereafter, rejoinder affidavit, if any, be filed.
List this matter for final hearing on 07.07.2023.
