1. Mr. Sudhir Kumar and Mr. Devesh Upreti, learned counsels for the appellant.

2. After he had concluded arguments, and we had dictated the judgment, counsel for the appellant, now informs us that the respondent has moved an application under Order 9 Rule 13 CPC to seek the setting aside of the ex-parte judgment and decree dated 03.08.2012, under Section 9 of the Hindu Marriage Act, passed by the Family Court, Lucknow, and that the said application is still pending consideration.

3. Till that application is decided, this appeal cannot proceed. We, accordingly, adjourn the appeal to 30.10.2023.

4. The appellant should place the current status of the said application before the Court on the next date.
