Mr. Manoj Kumar, learned counsel for the appellant.

Mr. T.C. learned Deputy Advocate General for the State.

On a mention being made, the records of appeal was summoned from the Registry.

Though the appeal is reported to be defective but the defects are overruled on the ground that the criminal appeal which has been preferred before this Court is as against the judgment of Judicial Magistrate, Tanakpur, District Champawat, which would not be maintainable before this Court, rather the appeal would lie before the Sessions Judge.

In that eventuality, learned counsel for the appellant seeks to withdraw the appeal with the liberty reserved for him to approach the appropriate appellate forum in accordance with law.

The Registry is directed to return the certified copy of the impugned judgment by substituting the same by zerox copy.
