This Application for Leave to Appeal, has been preferred by the State, as against the judgment of acquittal, along with the Delay Condonation Application, seeking condonation of 14 days of delay, which has chanced in preferring the Appeal.

The respondent was noticed. He had earlier filed vakalatnama as back as on 1st September, 2017, but objection to the delay condonation was not filed, and thereafter, with a change of the Counsel, Mr. Ramji Srivastava, Advocate, had put in appearance on 15th November, 2022. He too did not file any objection to the Delay Condonation Application.

Considering the period, for which, the proceedings are being kept pending, without there being any objection filed to the Delay Condonation Application, filed in support to the Application for Leave to Appeal, this Court being satisfied with the grounds taken therein, feels it appropriate to condone the delay, which has chanced in filing the Application for Leave to Appeal.

Hence, the delay of 14 days, which has chanced in preferring the Appeal, would stand condoned.

Learned counsel for the respondent prays for and is granted two weeks' time to file objection to the Application for Leave to Appeal.

List immediately after two weeks.
