Hon'ble Alok Kumar Verma,J.

Revisionists-accused was convicted and

sentenced to undergo rigorous imprisonment for a period

of three years along with a fine of Rs. 10,000/- for the

offence punishable under Section 51 of the Wild Life

(Protection) Act, 1972.

2. Against the judgment dated 16.05.2018, passed

by learned Trial Court, a Criminal Appeal (No.82 of 2018)

was filed. The said Appeal has been dismissed vide

judgment dated 20.02.2023, passed by learned IInd

Additional District and Sessions Judge, Nainital.

3. Heard Mrs. Sheetal Selwal, learned counsel for

revisionist and Mr. Pramod Tiwari, learned Brief Holder for

State.

4. Counter affidavit is taken on record.

5. Heard on the Bail Application (IA No. 1 of 2023).

6. Mrs. Sheetal Selwal, Advocate, has submitted

that there are substantial doubt about the conviction and

the revisionist was on bail during trial and appeal, and, the

conditions of bail were neither misused nor violated by

him.

7. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the revisionist,

namely, Virendra Pal.

8. Let the revisionist Virendra Pal be released on

bail on executing his personal bond and furnishing two

reliable sureties, each in the like amount, to the

satisfaction of Trial Court.

9. List on the date fixed i.e. on 10.08.2023.

10. Urgency Application (IA No.3 of 2023) stands

disposed of accordingly.
