An Original Suit (O.S. No.436 of 2011) was filed by respondent no.1 - plaintiff against the proposed appellant and proforma respondent no.2. The said Original Suit was dismissed. Against the judgment and decree dated 01.02.2016, passed by learned Trial Court, a Civil Appeal (Civil Appeal No.7 of 2016) was filed by the plaintiff. The Appellate Court vide impugned judgment and decree dated 05.10.2021 has remanded the case to the Trial Court. Against the judgment and decree dated 05.10.2021, proposed Second Appeal has been filed.

2. Heard Mr. Kishore Kumar, learned counsel for the proposed appellant.

3. Learned counsel for the proposed appellant has requested to permit the proposed appellant to withdraw the present appeal.

4. The proposed Second Appeal (No.107 of 2021) is dismissed as withdrawn.
