2. Mr. T.A. Khan, senior counsel assisted by Mr. Mohd. Shafy, counsel for the respondent.
3. Learned counsel for the appellant prays for and is allowed to withdraw the time extension application (MCC No.2 of 2023).
4. Likewise, learned counsel for both the parties pray for and are allowed to withdraw the compromise application (IA No.3 of 2023).

5. Present First Appeal has been preferred against the judgment and decree dated 23.03.2023, passed by the learned Senior Civil Judge, Haldwani in O.S. No.34 of 2004 titled as "M/s Century Textiles and Industries Limited vs. M/s Kiran Traders".
6. On the compromise application moved by the parties, this court, vide order dated 19.07.2023, had directed the parties to appear before the Registrar (Judicial) for verification and who in turn was directed to verify the compromise filed by the parties by way of compromise application (IA No.4 of 2023) and to submit report thereafter.
7. In compliance thereof, Registrar (Judicial) has submitted a detailed report thereby verifying the compromise filed by the parties. Report submitted by Registrar (Judicial) is taken on record.
8. In view of the above, the present first appeal is disposed of on the basis of compromise entered between the parties. The compromise deed shall form part of this order.
9. All pending applications stand disposed of.
