HIGH COURT OF UTTARAKHAND AT
NAINITAL
Writ Petition (M/S) No.2036 of 2023
Shubham Chand ....Petitioner
Versus
State of Uttarakhand and Others ....Respondents
Present:-
Mr. M.K. Chand, Advocate for the petitioners.
Mr. Suyash Pant, Standing Counsel for the State.
Mr. Manoj Kumar, Central Government Standing Counsel
for the respondent no.4.
JUDGMENT
Hon'ble Ravindra Maithani, J. (Oral)
The petitioner claims caste certificate under a
particular category, which has been denied to him by the
rejection order dated 29.06.2023. It has been challenged with
the further relief that the respondent authorities may be
directed to issue OBC certificate to the petitioner.
2. Heard learned counsel for the parties and
perused the record.
3. Learned counsel for the petitioner would submit
that the order rejecting caste certificate is appealable before
the Sub-Divisional Magistrate concerned and against it,
another appeal is provided before the District Magistrate, by
virtue of Government Order No. 198/XXX(6)/2022-20(02)21
dated 20.06.2022.
4. Since the issue can be raised in the department
alone, this Court does not see any reason to make any
interference, at this stage. Accordingly, the petition deserves
to be dismissed at the stage of admission itself.
5. The petition is dismissed in limine.
