Revisionist - accused Ujjawal Goswami was convicted by the Trial Court under Sections 420, 468 and Section 471 of the Indian Penal Code, 1860 (in short, "IPC"). He was sentenced to undergo rigorous imprisonment for a period of five years along with a fine of Rs.2,000/- for the offence punishable under Section 420 IPC; he was sentenced to undergo rigorous imprisonment for a period of five years along with a fine of Rs.2,000/- for the offence punishable under Section 468 IPC; and, he was further sentenced to undergo rigorous imprisonment for a period of five years along with a fine of Rs.2,000/- for the offence punishable under Section 471 IPC. All the sentences were directed to run concurrently.

2. An Appeal (Criminal Appeal No.47 of 2022) was filed against the judgment of the Trial Court. The appeal has been decided by the Appellate Court on 22.11.2022. The conviction and sentence passed by learned Trial Court under Section 420 and Section 468 IPC have been confirmed by the Appellate Court and while confirming the conviction passed under Section 471 IPC, the sentence of the revisionist has been reduced and he has been directed to undergo rigorous imprisonment for a period of two years.

5. Heard Mrs. Prabha Naithani, learned counsel for the revisionist and Mr. V.S. Rathore, learned A.G.A. for the State on Bail Application (IA No.1 of 2022)

6. Learned counsel for the revisionist has submitted that there are substantial doubts about the conviction. Revisionist is a permanent resident of District Haridwar.

7. Mr. V.S. Rathore, learned A.G.A. for the State opposed by the bail application.

8. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the revisionist, namely, Ujjawal Goswami, provided he submits his personal bond and two reliable sureties, each in the like amount to the satisfaction of the court concerned.

9. Bail Application is allowed accordingly.
