The Court made the following:
JUDGMENT:(per Hon'ble The Chief Justice Sri Vipin Sanghi)
After some arguments, Mr. Singh states that the
appellants would be satisfied if the liberty of the appellants is
preserved to initiate appropriate civil and criminal action in
respect of the alleged taking away of Rs.1,70,10,000/- from
the house of appellant no.2- Mr. Deepanshu Agarwal by the
police on 28.04.2023.
2. The appeal is dismissed by reserving the aforesaid
liberty of the appellants.
3. We make it clear that we have not expressed any
opinion on the merits of the appellants' claim one way or
another and this order shall not be construed by any
authority as an order on the merits of the appellants' claim.
4. We may also observe that the impugned order shall
not come in the way of the appellants, or the authorities in
examining the claim of the appellants.
5. The appeal stands dismissed in the aforesaid terms.
6. Pending application, if any, also stands disposed of.
