The proposed Appeal has been filed under Order 43 Rule 1 (r) of the Code of Civil Procedure, 1908 against the ex- parte judgment and order dated 04.10.2021, passed by the learned Senior Civil Judge, Rishikesh, Dehradun in Miscellaneous Case No. 15 of 2016, "Swami Krishnacharya Ji Maharaj Vs. Shri Rishikesh Giri", whereby, the said case, filed under Order 39 Rule 2-A of the Code of Civil Procedure, 1908, has been allowed and the appellant has been sentenced to civil imprisonment for a period of one month.
Heard Mr. Nikhil Singhal, learned counsel for the appellant.
The proposed appeal has been filed alongwith an application under Section 5 of the Limitation Act, 1963 to condone the delay of 211 days in filing the said appeal.
Issue notice to the respondent on the delay condonation application.
