Mr. Suresh Chandra Bhatt, learned Advocate for the applicant and Mr. S. S. Adhikari, learned Deputy Advocate General for the State.
A First Information Report was lodged against the respondent no. 2 under Sections 354 and 506 of the Indian Penal Code, 1860. After completion of the investigation, a closure report was filed by the Investigating Officer. The Informant filed a Protest Petition. The Protest Petition was dismissed. The informant filed a Criminal Revision (No. 126 of 2021). The said Revision has been dismissed vide judgment and order dated 25.07.2022, passed by the learned 1st Additional Sessions Judge, Rishikesh, District Dehradun. Hence, the present Application under Section 482 of the Code of Criminal Procedure, 1973.
Heard.
Learned counsel for the applicant submitted that the Investigating Officer did not record the statement of the victim-wife of the informant.
Learned counsel for the State submitted that it is a fresh case and requested two weeks' time to get instructions.
