The applicant/appellant is a convict for commission of the offence under Sections 376, 363 and 366-A of the IPC, and presently, undergoing his sentence, which has been imposed upon him by the judgment of conviction dated 23rd October, 2021, which has been passed by the Court of FTC/Addl. Sessions Judge, Roorkee, District Haridwar, in Sessions Trial No. 63 of 2018, State Vs. Ashu.
The appellant/applicant has filed the Short Term Bail Application, seeking short term bail on the ground, that marriage of his brother is to be solemnized on 23rd February, 2023.
The Short Term Bail Application, would stand allowed for a period of one month from the date of release of the appellant, subject to his furnishing of a personal bond and two sureties of the like amount to the satisfaction of Magistrate concerned.
The learned Trial Magistrate is directed to ensure to release the applicant by 23rd February, 2023 itself.
Let copy of the order be given to the learned counsel for the applicant on payment of usual charges today itself.
