This is a Criminal Appeal, preferred by the appellant, who has been convicted for the offences under Sections 3/25 of the Arms Act, as a consequence of sentencing of the culmination of Sessions Trial No. 86 of 2010, State Vs. Bijendra @ Beeru.
In fact, with efflux of time, it seems that the appellant has already served the sentence, but none of the counsels are in a position, to inform the Court, as to whether, in pursuance to the judgment of conviction, whereby the appellant has been directed to undergo two years of rigorous imprisonment, the appellant has been released on bail or not?
Be that as it may, because of the fact, that during the intervening period, the appellant had been transferred to Bulandshahr, the said information is not available to the learned Government Advocate.
Since the appellant has already served the sentence and has not been released on bail till date, as preferred by him, the Bail Application (IA/1/2021) would stand allowed. The appellant is hereby directed to be released forthwith upon the furnishing of his personal bond.
