This is application seeking leave to appeal filed by State against the judgment and order dated 01.06.2022 passed by learned Additional Sessions Judge, Kotdwar, Distict Pauri Garhwal, in Sessions Trial No. 01 of 2020, State Vs. Gaje Singh and others, whereby, all the accused persons were acquitted of the charges under Sections 498- A, 304-B, 506, in alternative Section 302 of IPC and 3/4 of Dowry Prohibition Act.
4. Since, the appeal filed by the victim under Section proviso (2) to Section 372 of Cr.P.C. is admitted and also in view of the submission made by learned State Counsel, we are inclined to grant application seeking leave to appeal. Accordingly, application seeking leave to appeal is allowed.
