2. Petitioner has challenged the judgment rendered by Central Administrative Tribunal, Circuit Bench, Nainital in T.A. No. 1 of 2023. By the impugned judgment, petitioner's original application was dismissed by holding that his application did not reach the Central Registry of Department of Personnel & Training, Ministry of Personnel Public Grievances & Pension, Government of India, in time. Learned Tribunal has held that last date for submission of application was 23.03.2020; while, petitioner's application could reach the Ministry only on 29.05.2020. Petitioner disputes the said finding by relying on Postal Tracking report, which is enclosed as Annexure No.A-4 to the writ petition. Based on said report, it is contended that envelope containing petitioner's application reached its destination on 20.03.2020.

3. Issue notice to respondent no.4, returnable within a period of four weeks, by registered post, acknowledgment due.

4. As prayed, four weeks' time is granted to learned counsel for the respondent(s) to file counter affidavit(s). In the counter affidavit, to be filed, respondent no.1 shall mention the date of delivery of envelope containing petitioner's application in the Central Registry of D.O.P.T.
