of 2011, Abhinav Bhandari and another Vs. Dr. Usha Kiran Bhandari and others, which has been preferred by the respondent, in which, he was later on impleaded by an order dated 6th January, 2023. He filed his written statement on 18th January, 2023, along with the counter claim under Order 8 Rule 6A of the CPC, which has been rejected by the Trial Court, and later on, affirmed by the Revisional Court by the judgment dated 31st May, 2023.

The rejection of the counter claim concurrently by the Court below was on the ground, that since the principal relief in the suit was distinct to the one sought in the counter claim, the counter claim was held to be not tenable.

Matter requires scrutiny.

Let notices be issued to the respondents. Steps to serve the respondents would be taken by the petitioner within a period of one week from today. Apart from serving the respondents by registered mode, he will also ensure service upon them by 'dasti'.

List this Writ Petition, as soon as service is effected on the respondents.
