The Court made the following:

JUDGMENT: (per Hon'ble The Chief Justice Sri Vipin Sanghi)



             The respondent has filed his counter-affidavit.


2)           The present District Magistrate, Rudraprayag,

has also joined the proceedings virtually.


3)           We have heard learned counsels.


4)           The respondent has stated in his counter-

affidavit that the impugned order by which the petitioner

is aggrieved, has been revoked, vide order dated

09.08.2023, passed by the current District Magistrate.

The impugned order had been passed by the erstwhile

District Magistrate, who has since been moved to

another District.


5)        Mr. Kothari states that the grievance of the

petitioner stands redressed.


6)        We are, therefore, closing these proceedings.

However, the District Administration is directed to act

with greater caution, while keeping in view the law,

particularly, when they are seeking to adversely affect

the civil rights of parties. No further orders are called

for.


7)        The   writ    petition   stands   disposed   of   as

infructuous.
