Mr. Ravi Bisht, Advocate for the applicant. Mr. Pratiroop Pandey, A.G.A. for the State. The criminal proceedings stood initiated against the present applicant, by registration of the FIR No. 123 of 2020, dated 04.04.2020, which was registered under Section 3/7 of the Essential Commodities Act. On the culmination of investigation, a charge-sheet has been submitted, on which the cognizance has been taken.
The learned counsel for the applicant, at the very inception of proceedings, has submitted that looking to the nature of offence, and, the sentence which it carries, it would be falling well within the parameters which had been laid down by the Hon'ble Apex Court in Satender Kumar Antil vs. Central Bureau of Investigation & others, as reported in (2021) 10 SCC 773, and particularly, it will fall to be within the ambit of consideration, as per the guidelines framed under Para 3 of the said judgment.
Owing to the aforesaid statement made by the counsel, and, as pleaded too in the C482 application, the C482 application is being disposed of with a liberty left open for the applicant to surrender before the Court of Chief Judicial Magistrate Udham Singh Nagar and seek his appropriate remedies, under para 3 of the judgment of Satender Kumar Antil (supra).
Subject to the aforesaid, the C482 application stands disposed of.
