The present Civil Appeal has been filed under Section 96 of the Code of Civil Procedure, 1908 against the judgment and decree dated 22.07.2022, passed by the learned Civil Judge (Senior Division), Kashipur, District Udham Singh Nagar in Original Suit No.48 of 2014, "Sukhdev Singh Sidhu vs. Harbhajan Singh (deceased) and Others", by which, the said original suit, filed by the appellant-plaintiff for cancellation of sale deed dated 01.03.2014 and for perpetual injunction, has been dismissed.

Heard Mr. Atul Kumar Bansal, the learned counsel for the appellant.

The learned counsel for the appellant submitted that the property-in-question is an ancestral property, which his father Harbhajan Singh (deceased respondent no.1) has sold to the respondent no.5 (deceased) and the respondent no.6, while the appellant- plaintiff has 50% share in that property.

Admit.

Issue notice to the respondent nos. 2 to 4 and 6 to 10.

Steps to be taken within three days. List this case on 19.10.2022. In the facts and circumstances of the case, both the parties are directed to maintain status quo over the property-in- question till the next date of listing.
