Heard Mr. Siddhartha Singh, learned counsel for the appellants and Mr. Vikas Bahuguna, learned counsel for the respondent.
On 24.09.2022, the Co-ordinate Bench of this Court had directed to keep the operation of the impugned judgment in abeyance.
Mr. Vikas Bahuguna, learned counsel for the respondent, submitted that the appellants have not deposited the disputed amount under the provisions of sub-rule (5) of Rule 5 of Order 41 of C.P.C.
The disputed amount has to be deposited under the said provisions.
Mr. Siddhartha Singh, the learned counsel for the appellants, requested four weeks' time to deposit Rs.4,00,000/- (Rupees four lakhs) before the Registry of this Court.
Subject to depositing of Rs.4,00,000/- (Rupees four lakhs) within four weeks from today, the interim order dated 24.09.2022 is extended till further order.
The learned counsel for the parties requested for paper books.
The Registry is directed to prepare the paper books and supply the same to the learned counsel for the parties, as per Rules.
