Mr. Tapan Singh, the learned counsel for the petitioner.
The petitioner in this case has prayed for initiation of the contempt proceedings for alleged violation of the judgment passed by the Court on 24.06.2022 in Appeal from Order of the learned District Judge, Haridwar.
In the operative portion of the appeal this Court has directed that the amount deposited by the UPAEVP shall be released in favour of the appellant and the remaining amount shall be paid to the appellant by UKAEVP along with interest @ 9% per annum only on the unpaid portion of the award within a period of three months. However, in the meantime, the petitioner has already approached the District Judge for execution of the part of the award in favour of the petitioner even prior disposal of the writ petition. Hence, contempt petition is not maintainable.
In that view of the matter, contempt petition is dismissed. However, the petitioner should file appropriate application to incorporate the order in the execution petition before District Judge, Haridwar.
