The respondent-plaintiff Methodist Church in India had filed an Original Suit (No.10 of 2013) for possession. According to the plaint the proposed appellant-defendant was in possession of the property-in-dispute illegally, therefore, the suit was filed. The Original Suit was decreed. Against the said judgment and decree, passed by the learned trial court, a Civil Appeal was filed. The Civil Appeal (No.14 of 2019) has been dismissed vide impugned judgment and decree dated 04.08.2022. Hence, the proposed Second Appeal.

Heard Mr. Siddhartha Sah, the learned counsel for the proposed appellant.

The learned counsel appearing for the proposed appellant submitted that the appellant was tenant over the property-in-question and requested to summon the original record before considering the matter for admission.
