The proposed Civil Revision has been filed under Section 25 of the Provincial Small Cause Courts Act, 1887 against the judgment and decree dated 28.08.2021, passed by the Judge, Small Cause Court/ Ist Additional District Judge, Kashipur, District Udham Singh Nagar in SCC Suit No.08 of 2015, "M/s Kashipur Agro Industries Pvt. Ltd., Kashipur vs. M/s Sai Sugar Products and Others", by which, the said suit has been decreed against the proposed revisionists and the respondent nos.2 and 5.
Heard Mr. Shankar Agarwal, learned counsel holding brief of Mr. Ramji Shrivastava, learned counsel for the proposed revisionists and Mr. Sudhir Kumar, learned counsel for the respondent no.1 - plaintiff.
During the arguments, the learned counsel appearing for the respondent no.1- plaintiff submitted that the plaintiff and the revisionists have entered into a compromise and according to the compromise, the revisionists have paid a part of the decreetal amount and the plaintiff has relinquished the balance decreetal amount, passed against the revisionists.
After the said submissions, the learned counsel for the proposed revisionists submitted that the present matter has become infructuous.
The proposed Civil Revision (No.60 of 2022) is dismissed as infructuous.
