Hon'ble Alok Kumar Verma,J.

The applicant-accused Guddu alias Nooralam, has

invoked the inherent jurisdiction of this High Court under

Section 482 of the Code of Criminal Procedure, 1973, to

quash the charge-sheet, cognizance/summoning order

dated 27.02.2021 and the entire proceedings of Criminal

Case No.2857 of 2021, ""State vs. Mahipal and Others",

under Section 354 of IPC, pending before the Chief Judicial

Magistrate, Haridwar, District Haridwar.

2. Heard Mr. Gaurav Singh, learned counsel for the

applicant and Mr. Lalit Miglani, learned AGA for the State.

3. During the arguments, the learned counsel for

the applicant-accused submitted that this criminal

miscellaneous application may be disposed of with the

direction to the concerned magistrate to decide the bail

application of the applicant in terms of the judgment of the

Hon'ble Supreme Court, passed in "Satender Kumar

Antil vs. Central Bureau of Investigation and

Another", (2021) 10 SCC 773.

4. The learned counsel for the State has no

objection.

5. The present Criminal Miscellaneous Application

(No.768 of 2022), filed under Section 482 of the Code of

Criminal Procedure, 1973, is disposed of with the direction

to the concerned trial court, in case, the applicant,

namely, Guddu alias Nooralam, moves bail application, the

trial court shall consider the same in the light of the

directions passed by the Hon'ble Supreme Court in the

abovementioned case.
