Heard learned counsel for the parties.

Since common questions of law and facts are involved in these writ petitions, therefore they were heard together and are being decided by a common judgment. However for sake of brevity, facts of Writ Petition (S/S) No.983 of 2022 are being considered and discussed.

Petitioner is serving as Amin in State Public Works Department. He has been transferred from Bhatwadi in District Uttarkashi to Ranikhet in District Almora vide order dated 18.05.2022, which is under challenge in this writ petition.

Transfer is an incidence of service and petitioner holds a transferable post, therefore, this Court is not inclined to interfere with the impugned transfer order. However, having regard to the facts & circumstances of the case, the writ petitions are disposed of with liberty to petitioner(s) to make representation(s) to respondent no. 2, within 48 hours. Such representation(s) can also be made through e-mail. If such representation(s) is made within stipulated time, respondent no. 2 shall take decision on petitioners' representation, within two weeks from the date of receipt of representation alongwith certified copy of the order.

Till such a decision is taken, writ petitioner(s) shall not be relieved from his present place of posting. In case no representation is made within stipulated time, then petitioner(s) shall not be entitled to protection of this order.

Let a certified copy of this order be issued, today itself.
