This criminal revision is preferred against the judgment and order dated 10.01.2022 passed by the learned Principal Judge, Family Court, Nainital in Criminal Case No.33 of 2021 "Smt. Kushika Sharma Vs. Anshul Kumar" filed under Section 125 Cr.P.C. whereby the concerned Court allowed the application and granted maintenance of Rs.25,000/- per month to the wife/ respondent no.2 from the date of the order.

Admit.

Issue notice to respondent no.2 Steps to be taken within seven days. List on 24.06.2022.

Heard on the interim relief application. It is the only submission advanced by the learned counsel for the revisionist that the revisionist did not receive the notice.

From the perusal of the impugned order, it is clear that no notice was served personally to the revisionist; the Court passed the ex-parte order, simply, on the basis of the publication.

Accordingly, execution of the impugned order dated 10.01.2022 will be kept in abeyance, provided the revisionist pays Rs.10,000/- per month to the respondent-wife.

The interim relief application (IA/1/2022) stands disposed of.
