Heard learned counsel for the parties.

WPSS No. 1810 of 2015 filed by the petitioners was allowed by Writ Court vide judgment dated 22.09.2021 and the respondents were directed to give benefit of Government Order dated 16.12.2011 to them. It was further provided in the said order that petitioners are also entitled to benefit of Assured Career Progression Scheme (A.C.P.).

Alleging wilful disobedience of the said order, this contempt petition has been filed.

A compliance affidavit has now been filed by District Magistrate, Udham Singh Nagar. With the said affidavit, an order passed on 25.04.2022 has been enclosed as Annexure No. 1 to the affidavit. Perusal of the said order reveals that necessary sanction for release of benefits, in terms of Government Order dated 16.12.2011, has been granted by District Magistrate.

On 17.05.2022 statement made by learned State Counsel was recorded that compliance of the order has been made and learned counsel for the petitioner was granted time to get necessary instructions in the matter. Today, learned counsel for the petitioner submits that, as per his instructions, petitioners are yet to receive the monetary benefit in terms of Government Order dated 16.12.2011.

Learned State Counsel, however, submits that monetary benefits admissible to the petitioners would be released as early as possible.

Having regard to the aforesaid facts, the contempt petition is disposed of by directing District Magistrate, Udham Singh Nagar to ensure that all the outstanding dues are released to the petitioner as early as possible, preferably within a period of four weeks from the date of production of certified copy of the order.

Contempt notices issued to the respondents are hereby discharged.
