This is an appeal against the Judgment and Order dated 11.05.2022, passed in Sessions Trial No.21 of 2019, under Section 8/20 of the Narcotic Drugs & Psychotropic Substances, 1985 State Vs. Mohd. Mujeeb and Another, passed by the court of Special Sessions Judge(NDPS), Almora.

Heard.

Sai Financial Service took money from various persons for grant of loan, but neither loan was sanctioned nor the amount was returned. An FIR was lodged which is the basis of the case.

It is argued that the petitioner was working as paid employee. Even his salary was not paid. Amount was not deposited in the account. He has also left the company. He has not committed any offence. Reference has been given to the statements recorded under Section 161 of the Code of Criminal Procedure, 1973.

Having considered, this Court is of the view that the matter definitely requires deliberation.

Issue notice to respondent no.2 returnable within four weeks.

Steps to be taken within a week. List thereafter.

Till the next date of listing, the proceeding of the case pending before the court below shall remain in abeyance qua the petitioner.
