Heard learned counsel for the parties on bail application.
It is stated by learned counsel for the revisionists that the revisionists were on bail during trial as well as during appeal and they never misused the bail granted to them. It is also submitted by learned counsel for the revisionists that the lower court passed the impugned judgment merely on the basis of surmises and conjectures. He also submitted that there are major contradictions in the statements of the witnesses. Furthermore, he submitted that the revisionists are languishing in jail since 21.04.2022.
Learned State Counsel although opposed the bail application but admitted that the revisionists were on bail during trial as well as during the appeal.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, I am of the opinion that the revisionists deserve bail at this Stage. Hence, the bail application is allowed.
Let the revisionists be released on bail on executing a personal bond and furnishing two reliable sureties, each in the like amount, by each of them, to the satisfaction of Court concerned, subject to deposit fine as imposed by the trial Court, if any.
