Hon'ble Manoj Kumar Tiwari, J.
Mr. Jitendra Chaudhary and Mr. Suhail Ahmed Siddiqui, Advocates for the petitioner.
Dr. K.H. Gupta, Advocate for respondent no. 2.
Heard learned counsel for the parties.
Learned counsel for respondent no. 2 submits that since the land in question is not recorded in the name of the petitioner, therefore, no sale deed can be executed by the petitioner in favour of the University, thus, it is not possible to pay the sale consideration in respect of the said land to the petitioner.
Learned counsel for the petitioner, however, submits that petitioner has already moved an application before the concerned Tehsildar for mutation, based on the judgment dated 05.03.2011
of 2010.
Since petitioner's application for mutation is pending before Tehsildar, Sri Nagar, therefore, the contempt petition is adjourned for a period of four weeks.
List this matter after four weeks. Tehsildar, Sri Nagar is directed to take decision on petitioner's application in the meantime.
