This is the Third Bail Application No.10491 of 2022, which has been preferred by the appellants seeking their release on bail for their alleged conviction by virtue of the judgment dated 19.01.2019, as rendered by the Sessions Trial No.93 of 2009 for the commission of the offences under Section 302/34 to be read with Section 201 of the IPC.
The sole ground which has been argued by the learned counsel for the appellant is that the appellants are languishing in jail since 19.01.2019.
Coupled with the fact that during the trial they were on bail and they were not named in the FIR.
We are inclined to release the appellants on bail subject to furnishing of the personal bond and two sureties each of the like amount to the satisfaction of the Magistrate concerned with the conditions that, in case, if the appellants are holding any passport they would surrender the same before the Magistrate concerned.
Subject to the above, Third Bail Application No.10491 of 2022 would stand allowed.
