Upon hearing the learned Counsel, the Court made the following
JUDGMENT : (per Sri S.K. Mishra, A.C.J.)
There is a delay of 407 days in preferring the
Special Appeal.
2. We have carefully perused the records and
heard the learned counsel for the appellant. We have
also heard Mr. Pankaj Purohit, learned counsel for
respondent No. 2.
3. The delay has not been properly explained by
the appellant.
4. Since we do not find any merit in the
Application for condonation of delay, the same is
dismissed.
5. Since the Special Appeal has been filed after
the delay, and the delay has not been condoned, the
same is not maintainable and is disposed of as such.
6. No order as to costs.
7. Urgent copy of this order be supplied to the
learned counsel for the parties, as per Rules.
