The present proposed appeal has been filed along with an application for special leave to appeal, against the judgment dated 30.04.2022, passed by the learned Additional Chief Judicial Magistrate/Ist Additional Civil Judge (Senior Division), Haridwar in Complaint Case No.129 of 2016, "M/S Pushpak Finance Singhdwar vs. Imran Ahmad", whereby, the respondent no.2-accused has been acquitted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881.
Heard Mr. Vaibhav Singh Chauhan, the learned counsel for the appellant and Mr. Pratiroop Pandey, the learned A.G.A. assisted by Mr. Pramod Tiwari, the learned Brief Holder for the State.
The learned counsel for the proposed appellant submitted that debt and signature on the cheque are admitted by the respondent no.2. The learned counsel further submitted that the complaint was filed in accordance with law.
Issue notice to the respondent no.2 on the special leave to appeal.
Steps to be taken within a week. Post this case on 03.08.2022.
