There is delay of 9 days in filing the Special Appeal. Delay condonation application (IA/2/2022) has been moved to condone the delay. The delay condonation application is not opposed by learned counsel for the respondent. Accordingly, delay condonation application is allowed and the delay of 9 days is condoned.

Learned counsel for the parties are in agreement on the point that similar petition is pending consideration before this Court in SPA No.408 of 2021 in which an interim order is also operating.

In such view of the matter, list this appeal, list this appeal after four weeks with SPA No.408 of 2021.

In the meantime, there shall be stay of the impugned judgment.
