This Appeal from Order has been preferred by the defendant/appellant, under Section 384 of the Indian Succession Act, whereby putting challenge to the judgment dated 13th January, 2010, as well as the succession certificate dated 27th January, 2010, as passed and granted by the Court of IIIrd Additional Civil Judge (S.D.), Dehradun, whereby, the succession application has been allowed, while issuing the succession certificate, in Misc. Case No. 449 of 1998.
The Appeal from Order, was admitted on 20th April, 2010, and notices were issued to the respondents.
Since they were not served with the notices, the appellant was directed to effect services on the respondents by way of paper publication.
Steps have been taken and the respondents have been served by the publication as made in the daily newspaper, Danik Jagran, Dehradun, on 7th August, 2019.
In that eventuality, it would be deemed that the respondents have been satisfactorily served with the notices, but since despite of the service of the notices, none has put in appearance even till date.
In these circumstances, the Appeal from Order is directed to be listed under the head of hearing in the 2nd week of July, 2022.
